Guest Terms & Conditions, Waiver, and Hold Harmless Agreement
This Guest Terms & Conditions, Waiver, and Hold Harmless Agreement (“Agreement”) is entered into by and between Wheat Creek Outpost, LLC (“Wheat Creek Outpost,” “Camp,” “we,” or “us”) and the undersigned guest(s) (“Guest,” “you,” or “your”). By making a reservation (online, over the phone, or in person), checking in, or entering the property located at 195 Fireside Trail, Mill Spring, North Carolina, you acknowledge and agree to the following:
1. Acknowledgment of Risks
You understand that staying in a natural, outdoor environment involves inherent risks, including but not limited to:

Slips, trips, or falls on uneven, wet, rocky, or natural terrain.

Encounters with insects, snakes, and wildlife, which may result in bites, stings, or other injuries.

Weather-related hazards such as storms, lightning, flooding, high winds, or falling branches.
-
Exposure to plants, including poison ivy or other irritants.
-
Hazards related to ponds, trails, fire pits, and other natural features.
-
Limited immediate access to emergency services or medical care.
You acknowledge that management is not on premises 24/7 and that you are responsible for your own safety and the safety of any children, pets, or visitors under your care.
2. Assumption of Risk
By entering the property, you voluntarily assume all risks of injury, illness, death, or property damage associated with your stay, whether foreseen or unforeseen, and whether caused by natural conditions, your own actions, the actions of other guests, or otherwise.
3. Release of Liability & Hold Harmless
To the fullest extent permitted by law, you hereby release, waive, discharge, and agree to hold harmless Wheat Creek Outpost, LLC, its owners, members, managers, employees, agents, contractors, and affiliates (collectively, the “Released Parties”) from any and all claims, demands, damages, losses, liabilities, costs, expenses, or causes of action of any kind, whether at law or in equity, arising out of or related to:

Personal injury, illness, or death;

Property damage, theft, or loss;

Wildlife encounters or insect bites;
-
Weather or naturally occurring events;
-
Use of tents, fire pits, trails, ponds, or any other facilities or natural areas;
-
Any occurrence beyond the direct control of the Released Parties.
This release applies to claims arising from ordinary negligence of the Released Parties and is intended to be as broad and inclusive as permitted under North Carolina law.
4. Indemnification
You agree to indemnify and hold the Released Parties harmless from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) brought by or on behalf of any third party arising from your actions, your negligence, or your violation of this Agreement.
5. Property Damage & Security
You agree to be financially responsible for any damages to tents, furnishings, facilities, or infrastructure caused by you, your guests, your children, or your pets. Wheat Creek Outpost is not responsible for lost, stolen, or damaged personal property.
6. Governing Law & Severability
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina. If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
7. Entire Agreement
This Agreement constitutes the entire understanding between you and Wheat Creek Outpost regarding liability, assumption of risk, and indemnification. It supersedes any prior representations or agreements, whether oral or written.
8. Acknowledgment & Acceptance
By signing below (or by completing an online booking), you acknowledge that you have read and understood this Agreement, and that you:

Voluntarily assume all risks associated with your stay at Wheat Creek Outpost.

Release Wheat Creek Outpost, LLC and its affiliates from liability to the maximum extent permitted by law.

Agree not to bring any legal action against Wheat Creek Outpost, LLC for injuries, damages, or losses sustained during your stay, except in cases of proven gross negligence or intentional misconduct.

Rules and Regulations
1. Reservations & Guest Policy
-
All guests must be registered through a reservation.
-
Maximum site occupancy: three (3) registered persons or one family unit.
-
No more than two (2) visitors per reservation. Visitors must leave by 10:00 PM.
-
Overnight, non-registered guests are not permitted.
-
Maximum length of stay: 14 consecutive days.
2. Check-In / Check-Out
-
Check-in: 3:00 PM | Check-out: 10:00 AM.
-
Contact management in advance for early check-in or late departure requests.
-
An early check-in fee may be required.

3. Noise, Conduct, and Events
-
Quiet hours: 10:00 PM – 7:00 AM.
-
No nuisance, noxious, or offensive behavior is permitted.
-
Radios, TVs, Bluetooth speakers, and similar devices must be kept at a respectful volume.
-
Parties are not permitted without prior approval. Private events may require a full-camp booking.
-
Management reserves the right to refuse or terminate service without refund for violations.
4. Safety & Emergencies
-
Dial 911 in an emergency. Address: 195 Fireside Trail, Mill Spring, NC. Provide dispatch with your location on the property.
-
Severe weather: Tents are wind-rated to 100+ mph. Shelter may also be sought in the Camp Lodge or in your vehicle. Management is not on-site 24/7; please have a personal contingency plan.

Weapons: Fireworks, firearms, BB guns, and similar items are prohibited. Lawful concealed carry is permitted; open carry is not allowed so as to not disrupt the other guests' experience.

Water: Swimming/wading is at your own risk. No lifeguards are on duty. Ponds, streams, and other water features on the property are not tested for bacteria or other contaminants that may cause injury or illness.
5. Vehicles & Parking
-
Park only in designated areas. No parking on grass or right-of-ways.
-
Maximum two vehicles per reservation.
-
Speed limit: 10 mph. Drive cautiously, watch for wildlife, and be respectful to our neighbors (do not use neighbors driveways as turn arounds)

RVs, campers, ATVs, UTVs, dirt bikes, golf carts, and other guest-owned motorized vehicles are prohibited without prior management approval.

Do not drive vehicles on trails; they are reserved for management and emergency vehicles.
-
Incoming traffic has the right of way. Please look for cars before exiting.
6. Garbage & Waste
-
NO garbage shall be left outside of your tent overnight, you will have visitors from our local wildlife.
-
Carry trash to designated receptacles (left of the parking area).
-
Ensure lids are closed tightly to prevent bear activity.
-
Household trash only. No large or construction debris. Larger items may incur a Polk County disposal fee.
7. Pets & Wildlife
-
Pets:
-
We are pet friendly and mean it! Only good girls and boys are allowed.
-
Pets may not be left unattended in tents or tied up outside. When leaving the property please bring your pet with you or make prior arrangements for short term boarding. For boarding recommendations please ask management or see our local guide. Violations will result in immediate removal without refund.

All pets must be up-to-date on common vaccinations (Rabies, Bordetella, Distemper, Hepatitis, Parvo, Parainfluenza, Leptospirosis, ect.).

Owners with aggressive or unruly pets will be asked to leave without refund or compensation.
-
Dogs may be off-leash away from main areas only if under direct voice control, per Polk county ordinance. Leashes are required around other guests and dogs.
-
Owners must clean up after pets and dispose of waste properly.
-
While we encourage your pets to find new friends on the property, please make sure an introduction is made on leash to prevent any ruined introductions.

Pets are not allowed to free roam the property and should not be left unattended. Other guests may not appreciate the visit as much as we do.

Wildlife:
-
Wheat Creek Outpost is a registered wildlife sanctuary. Do not disturb, feed, or harm wildlife.
-
Hunting is strictly prohibited. Violators will be asked to leave without compensation.
-
Snakes are present, venomous and non. Do not kill snakes. Walk away and contact management if necessary. See guides within the tent for tips on identifying a variety of wildlife.
-
If bitten by a snake, try to safely identify the species, and seek immediate medical attention and/or dial 911. Identifying the species will help emergency crews get you the correct antibiotics and/or antivenom.

Bears:
-
Bears are common in the area. Do not feed or approach them.
-
Store food securely inside tents, bear proof coolers (not provided) or refrigerators.
-
Dispose of trash properly; do not leave food or garbage outside.
-
Bears may damage vehicles if food or trash is left accessible.
-
8. Campfires & Fire Safety
-
Use designated fire pits/containers only. No open burning.
-
Firewood is available for purchase on-site or locally. Do not bring firewood from outside the immediate area. This is to prevent disease and/or non-native insect spread.
-
Fires must be attended at all times and fully extinguished before bed or departure. Hoses are provided and may be used to aid in this.
-
No burning trash — firewood only.
-
NC Forestry Commission burn bans must be strictly followed, management will inform guests if a burn ban is in effect. In this instance open burning is punishable by law and campfires will be prohibited for the protection of our guests and property.
9. Property Care

Guests are financially responsible for any damages to tents, furnishings, and/or infrastructure. Charges will be applied to the card on file.
-
Do not attempt to make repairs to utilities. Contact management immediately and we will do our best to have the issue resolved quickly.
-
Respect the land: leave no trace.
10. Cancellation Policy
-
Full refund available for cancellations made 29+ days prior to reservation.
-
50% refund for cancellations between 29 - 15 days out.
-
No refund will be given for cancellations 14 days to the day of booking.
-
Exceptions are made on a case by case basis but no guarantee of refund will be given for cancellations within these set parameters.
-
No refunds will be given for early departures, inclement weather, or violations of rules.
-
Refunds may be given but are not guaranteed, on a case by case basis, for incidents beyond the control of management.
11. Governing Law
These Terms & Conditions shall be governed by and construed under the laws of the State of North Carolina.
12. Guest Acknowledgment
By reserving and/or staying at Wheat Creek Outpost, you confirm that you:

Have read and understood these Terms & Conditions, Rules, and Regulations.

Accept full responsibility for yourself, your guests, your children, and your pets.
-
Voluntarily assume all risks associated with staying in a natural environment.
